By accessing and using Tailsy (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

What We Provide

• AI thumbnail generation
• Chat assistance for creative workflows
• Image upload, processing, and export
• Character/person training features
• Credit-based usage system

AI outputs may include artifacts or inaccuracies and should be reviewed for accuracy and suitability.

Account

• Provide accurate information and keep credentials secure
• You must be at least 13 years old (16 in some EU jurisdictions) to use the Service
• One account per person; do not share access

Prohibited Uses

• Illegal, harmful, or offensive content
• Infringement of third-party rights (copyright, publicity, trademarks)
• Harassment, discrimination, or hate speech
• Abuse of systems, rate limits, or security measures
• Resale or unauthorized commercialization of the Service

Credit System

• Features may require credits to use
• Credit costs vary by feature and complexity
• Consumed credits are non-refundable
• Unused credits may expire per plan terms

Billing Terms

• Payments are processed by a secure third-party payment processor
• Subscriptions renew automatically unless canceled
• Failed payments may suspend access
• Cancel anytime within your account

Refunds

• Subscriptions are billed in advance. Except where required by law, fees are non-refundable.
• We may, at our discretion, issue credits for outages or failed generations.
• Credit packs are non-refundable once delivered to your account.

Your Content

• You retain ownership of content you upload
• You grant us a license to process content to operate the Service
• You must have rights to the content you upload

Generated Content

• You own outputs generated using your credits, subject to law and third-party rights
• You are responsible for ensuring non-infringement and lawful use

Our IP

• Service technology, algorithms, and trademarks are our property
• No reverse engineering or circumvention

• You must have permission and necessary rights to use any person’s likeness and third‑party content you upload or generate.
• No non‑consensual, deceptive, or defamatory content. We may remove content and suspend accounts for violations.
• You are responsible for compliance with platform rules (e.g., YouTube) and local laws.

Your data is processed in accordance with our Privacy Policy.

Your Rights

• Access, portability, erasure, and withdrawal of consent where applicable

Uptime

• We aim for high availability but provide no formal SLA
• Maintenance and third-party outages may affect availability

Usage Limits

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

No Warranties

• No guarantees on output quality, fitness, or non-infringement
• No guarantee of uninterrupted availability
• No responsibility for third-party provider performance

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE GREATER OF (A) AMOUNTS PAID IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

If you believe content infringes your rights, email dmca@tailsy.com with:

• Identification of the copyrighted work
• Identification of the allegedly infringing material and its location
• Your contact information and a good-faith statement under penalty of perjury
• Your physical or electronic signature

By You

You may close your account at any time through your account settings or by contacting support. Upon closure, your data will be deleted in accordance with our Privacy Policy.

By Us

We may suspend or terminate your account for violations of these Terms, illegal activity, or extended inactivity. We will provide notice where practicable.

Effect of Termination

Upon termination, your right to use the Service ceases. Sections relating to IP, limitations, indemnification, and governing law survive termination.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Tailsy regarding the Service.

Beta Features

Certain features may be labeled as alpha/beta/preview. They are provided as-is and may change or be discontinued at any time.

Feedback

If you provide ideas or suggestions, you grant Tailsy a perpetual, irrevocable, royalty-free license to use them without restriction.

Export Controls

You represent that you are not located in a sanctioned country and agree to comply with applicable export control and sanctions laws.

Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control.

Assignment

We may assign these Terms. You may not assign without our prior written consent.

Severability

If any provision is found unenforceable, the remainder remains in full force.

Waiver

Failure to enforce a provision is not a waiver of the right to do so later.

Publicity

We will not publicly display or use your content for marketing without your prior consent.

Notices

We may provide notices via email, in-app messages, or by posting on the site.

Electronic Communications & Signatures

You consent to receive communications electronically and agree that electronic signatures and records have the same effect as originals.

We may modify these Terms and will notify of material changes by:

• Emailing registered users
• Prominent in-app or site notices
• Updating the “Last updated” date above

Your continued use after changes means you accept the updates.
